Terms of Service

These Terms of Service ("Terms") govern your access to and use of talentbinocstech.com and the TalentBinocs Tech recruiter platform operated by TalentBinocs Tech ("TalentBinocs Tech", "we", "us", or "our").

1. Eligibility

The platform is intended for recruiters, hiring teams, talent professionals, and organizations engaged in legitimate recruitment activities.

To use the platform, you must:

• Be at least 18 years old
• Provide accurate account information
• Use the platform only for lawful business purposes

2. Account Responsibilities

• You are responsible for maintaining account security.
• You are responsible for all activities conducted through your account.
• You must promptly notify us of any unauthorized access or suspected security breach.
• Shared credentials and impersonation are prohibited.

3. Permitted Use

You may use the platform to:

• Manage recruitment workflows
• Upload and review candidate information
• Coordinate hiring processes
• Access AI-assisted recruiting features

4. Prohibited Use

You must not:

• Violate applicable laws or regulations
• Upload unlawful, infringing, or malicious content
• Use the platform for spam or harassment
• Reverse engineer, scrape, or exploit the platform
• Interfere with platform security or operations
• Use the platform for unlawful discrimination, fake job schemes, human trafficking, fraudulent hiring activity, or other illegal employment-related conduct

5. Candidate Data & Lawful Basis

When uploading candidate resumes or personal information, you represent and warrant that:

• You have all necessary rights, permissions, and lawful basis required to upload and process candidate data.
• The data is used solely for legitimate recruitment purposes.
• You comply with all applicable privacy, employment, and anti-discrimination laws.
• You will not misuse or unlawfully distribute candidate information.

TalentBinocs Tech does not independently verify whether users have obtained the necessary permissions or lawful basis to upload candidate information.

6. AI-Assisted Features

The platform may provide AI-assisted summaries, classifications, recommendations, or fit scores generated using automated systems and third-party AI providers.

AI-generated outputs may be inaccurate, incomplete, biased, or unsuitable for a particular role or jurisdiction. TalentBinocs Tech does not guarantee the accuracy, fairness, legality, or reliability of AI-generated outputs.

Users remain solely responsible for reviewing candidate information and making independent employment decisions in compliance with applicable laws.

7. Platform Role

TalentBinocs Tech is a software platform that facilitates recruitment workflows and candidate management.

TalentBinocs Tech is not an employer, staffing agency, employment agency, or recruiting firm, and does not participate in employment decisions between recruiters and candidates.

All screening, interviewing, evaluation, and hiring decisions are made solely by users of the platform.

8. Intellectual Property

TalentBinocs Tech and its associated software, branding, workflows, content, and platform features are protected under applicable intellectual property laws.

You receive a limited, non-exclusive, non-transferable license to use the platform for its intended purposes.

You retain ownership of content you upload. By uploading content, you grant TalentBinocs Tech a limited license to store, process, analyze, and display the content solely for operating and improving the platform.

9. Fees & Payment

Certain platform features may require payment or subscription fees. Pricing, billing terms, and cancellation policies may be updated periodically.

We reserve the right to change fees with reasonable notice.

10. Termination

We may suspend or terminate accounts that violate these Terms, misuse the platform, or create security, legal, or operational risks.

You may stop using the platform at any time.

11. Disclaimers

The platform is provided on an "as is" and "as available" basis without warranties of any kind.

TalentBinocs Tech does not guarantee uninterrupted availability, hiring outcomes, successful placements, or error-free operation.

TalentBinocs Tech does not verify the authenticity, accuracy, completeness, legality, or reliability of user-uploaded content, including resumes, recruiter notes, or job postings.

Features, workflows, AI models, integrations, and platform functionality may change, be added, or removed at any time without prior notice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, TalentBinocs Tech shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the use of the platform, including loss of profits, loss of business opportunities, reputational harm, hiring outcomes, data loss, or business interruption, even if advised of the possibility of such damages.

TalentBinocs Tech’s aggregate liability arising out of or related to the platform shall not exceed the greater of:

• the fees paid by you to TalentBinocs Tech in the preceding twelve (12) months; or/li>
• INR 10,000.

The foregoing limitations shall not apply to liability arising from fraud, willful misconduct, gross negligence, breach of confidentiality obligations, or violations of applicable data protection laws.

13. Indemnification

You agree to indemnify and hold harmless TalentBinocs Tech, its affiliates, officers, employees, contractors, and agents from claims, liabilities, losses, damages, and expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Candidate data or content uploaded by you

14. Force Majeure

TalentBinocs Tech shall not be liable for delays, interruptions, or failures caused by events beyond our reasonable control, including internet outages, cyberattacks, cloud infrastructure failures, governmental actions, labor disputes, natural disasters, or failures of third-party service providers.

15. Changes to These Terms

We may update these Terms periodically. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the platform shall be subject to the exclusive jurisdiction of courts located in Bengaluru, Karnataka.

17. Third-Party Services

The platform relies on the following third-party service providers. By using the platform, you acknowledge that your data may be processed by these providers subject to their respective terms and privacy policies.

• Supabase — authentication, database, and backend infrastructure
• Cloudflare R2 — file storage for uploaded resumes and candidate documents
• Resend — transactional email delivery
• Google Gemini (Google AI) — AI-powered resume anonymization and candidate fit scoring; resume text is transmitted to Google's servers for processing
• Groq — AI inference fallback for resume summarization and scoring; resume text is transmitted to Groq's servers for processing

TalentBinocs Tech is not responsible for the availability, conduct, or data practices of these providers. We will update this section as integrations change.
